Notice and Takedown Policy

Dear Right Holder,

If you hold appropriate IP Rights in any Content posted by Users through Service provided by www.ex.ua, and if you deem such posting an infringement of your Rights, we will be happy to facilitate you in removing access to such Content.

In order to notify us of the alleged infringement, please contact us via support@ex.ua to provide the following required minimum of information:

(a) Name of the Right Holder;
(b) Your name, if different from (a), as well as a statement with regard to your position to represent the Right Holder;
(c) Direct URL(s) of the web pages containing and/or directly leading to allegedly infringing Content. The URL(s) shall have the format http://www.ex.ua/view/______ or similar;
(d) Your Declaration of appropriate Rights in the Content.

You are free to submit electronic (scanned) copies of any documents in support of your claims. We also reserve the right to request, at our discretion and in any case as we deem appropriate, electronic (scanned) copies of documents confirming your identity, position and/or validity of your right to prohibit distribution of Content on the Internet.

Please further note that claims received at support@ex.ua are normally, without prejudice to our right to make exclusions, published in the special “Right Holder Claims” section of ex.ua.

Please fundamentally note that we provide Information Society Service that consists of the storage of information provided by Users. Prior to posting Content, each User confirms his/her consent to abide by the Terms of Service, whereby the User represents and warrants that he/she possesses the full right to post Content, and that to the best of his/her knowledge, posting of Content does not infringe Intellectual Property Rights of third parties. We do believe that most of our Users effectively abide by the Terms of Service. We do not bear responsibility for the information stored at the request of Users unless we are properly notified of the actual infringement. As provider of the Service, we bear no general obligation to monitor the information which we store, nor a general obligation actively to seek facts of infringement of Rights. All postings of Content by Users shall be considered legitimate use of Information Society Service unless there are sufficient grounds to deem otherwise.

Please finally note that we consider cooperation to be a value, and most claims are effectively resolved in a positive manner — as may be easily proven by the “Right Holder Claims” section referred to above.
